Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using Kadence, you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised. You may not share your account or use someone else's account without permission.

3. The Service

Kadence lets you log workouts, track nutrition and body metrics, sync health and wearable data, participate in weekly leagues, and — where applicable — connect with a coach. We may add, change, or remove features over time. We aim to keep the Service available and reliable but do not guarantee uninterrupted access.

4. Subscriptions and payments

Kadence offers a free tier and a paid “Pro” subscription with additional features such as the web dashboard, unlimited history, and wearable sync. The following terms apply to paid subscriptions:

• Subscriptions are billed through the Apple App Store or Google Play, according to the plan you select (for example, monthly or annual).
• Subscriptions renew automatically until cancelled. You can manage or cancel your subscription in your app store account settings.
• Cancellation takes effect at the end of the current billing period; except where required by law, fees already paid are non-refundable.
• Prices and plan features may change. We will give notice of material changes where required, and changes will not affect the period you have already paid for.
• Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends.

Refunds for purchases made through the app stores are handled according to the applicable store's policies.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to access accounts, data, or systems that do not belong to you.
• Interfere with, disrupt, or place undue load on the Service or its infrastructure.
• Reverse engineer, scrape, or attempt to extract source code except where permitted by law.
• Upload content that is unlawful, infringing, harmful, or that you do not have the right to share.
• Misuse league, coaching, or social features to harass or deceive other users.

6. Your content

You retain ownership of the data and content you create in the Service, such as your workouts, logs, metrics, and journal entries (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service and to provide it back to you and to people you choose to share it with (such as a coach). You are responsible for Your Content and for ensuring you have the right to submit it.

7. Coaching features

If you connect with a coach through the Service, you authorize the sharing of the data you choose to make available to that coach. Coaches are independent third parties; we are not responsible for the advice, conduct, or services they provide. You may end a coaching connection at any time.

8. Health disclaimer

Kadence provides fitness and nutrition tracking tools for informational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning or changing any exercise, nutrition, or health program. You use the Service and rely on its information at your own risk.

9. Third-party services

The Service integrates with third-party services — including Apple Health, Google Health Connect, the Open Food Facts database, and the app stores. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

10. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by Kadence and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, the provisions of these Terms that by their nature should survive — including ownership, disclaimers, and limitations of liability — will continue to apply.

12. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be accurate or preserved.

13. Limitation of liability

To the maximum extent permitted by law, Kadence and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. To the extent liability cannot be excluded, it is limited to the amount you paid us, if any, for the Service in the twelve months before the claim.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the Service. Your continued use of the Service after an update means you accept the revised Terms.
